{"id":858,"date":"2016-05-06T00:27:09","date_gmt":"2016-05-06T00:27:09","guid":{"rendered":"https:\/\/cepiadet.org\/index.php\/2016\/05\/06\/scjn-analizara-el-derecho-a-la-educacion-de-comunidades-indigenas\/"},"modified":"2016-05-06T00:27:09","modified_gmt":"2016-05-06T00:27:09","slug":"scjn-analizara-el-derecho-a-la-educacion-de-comunidades-indigenas","status":"publish","type":"post","link":"https:\/\/cepiadet.org\/index.php\/2016\/05\/06\/scjn-analizara-el-derecho-a-la-educacion-de-comunidades-indigenas\/","title":{"rendered":"SCJN analizar\u00e1 el derecho a la educaci\u00f3n de comunidades ind\u00edgenas"},"content":{"rendered":"<p><img class=\\\"alignnone size-full wp-image-848\\\" src=\\\"https:\/\/cepiadet.files.wordpress.com\/2016\/05\/themexicantimes-mx.jpg\\\" alt=\\\"themexicantimes.mx\\\" width=\\\"1914\\\" height=\\\"1276\\\" \/><\/p>\n<p>En sesi\u00f3n de 4 de mayo de 2016, la Segunda Sala de la Suprema Corte de Justicia de la Naci\u00f3n determin\u00f3 ejercer su facultad de atracci\u00f3n bajo el expediente 19\/2016, en un asunto en el que pueden determinarse los alcances del derecho al acceso a una educaci\u00f3n aceptable para comunidades ind\u00edgenas.<\/p>\n<p>En el caso, se promovi\u00f3 un juicio de amparo en el que se propuso una interpretaci\u00f3n de los art\u00edculos 2, 3 y 4 de la Constituci\u00f3n Federal, as\u00ed como de diversas normas internacionales, entre ellas, el Protocolo Adicional a la Convenci\u00f3n Americana en Materia de Derechos Econ\u00f3micos, Sociales y Culturales, en relaci\u00f3n con el derecho al acceso a una educaci\u00f3n con caracter\u00edsticas de disponibilidad, accesibilidad, aceptabilidad y adaptabilidad para comunidades ind\u00edgenas, para concluir que una educaci\u00f3n aceptable necesariamente era una educaci\u00f3n intercultural biling\u00fce que implica, en esencia, una exposici\u00f3n significativa a la lengua ind\u00edgena materna desde la educaci\u00f3n prescolar e impartici\u00f3n de clases regulatorias a fin de equiparar los niveles de competencia en ambas lenguas.<\/p>\n<p><img class=\\\"alignnone size-full wp-image-845\\\" src=\\\"https:\/\/cepiadet.files.wordpress.com\/2016\/05\/www-somosunicef-com.jpg\\\" alt=\\\"www.somosunicef.com\\\" width=\\\"2000\\\" height=\\\"863\\\" \/><\/p>\n<p>La Segunda Sala de la Suprema Corte de Justicia de la Naci\u00f3n estableci\u00f3 en la resoluci\u00f3n que el asunto versa sobre una cuesti\u00f3n jur\u00eddica de gran inter\u00e9s y trascendencia, porque puede haber pronunciamiento sobre la interpretaci\u00f3n de los contenidos espec\u00edficos que deber\u00edan contemplarse en los planes de estudios para cumplir cabalmente con el derecho de acceso a una educaci\u00f3n adecuada, con espec\u00edfica atenci\u00f3n en la titularidad de ese derecho por parte de los ni\u00f1os ind\u00edgenas, y por la gran relevancia que podr\u00eda significar su resoluci\u00f3n en el dise\u00f1o de las pol\u00edticas educativas de nuestro pa\u00eds.<\/p>\n<p>Por tal raz\u00f3n, a juicio de la Sala, es importante que sea el Alto Tribunal el que emita tal resoluci\u00f3n, para que, de ser el caso, pueda servir de par\u00e1metro para la implementaci\u00f3n o eventualmente, modificaci\u00f3n de los planes y programas educativos a nivel nacional, y para que otros asuntos de la misma naturaleza puedan guiarse por los postulados que pueda llegar a emitir la Suprema Corte de Justicia de la Naci\u00f3n.<\/p>\n<p>Texto publicado originariamente en\u00a0http:\/\/www.internet2.scjn.gob.mx\/red2\/comunicados\/comunicado.asp?id=4306<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>En sesi\u00f3n de 4 de mayo de 2016, la Segunda Sala de la Suprema Corte de Justicia de la Naci\u00f3n determin\u00f3 ejercer su facultad de atracci\u00f3n bajo el expediente 19\/2016, en un asunto en el que pueden determinarse los alcances del derecho al acceso a una educaci\u00f3n aceptable para comunidades ind\u00edgenas.
